HB 1711 -- 'Amelia's Bill' -- Another Example of Emotion Working Against Logic and Freedom
Pinpointed by the Samurai Appliance Repairman (www.fixitnow.com), HB 1711 was discussed on "Against the Grain", on January 30, 2006.
The bill is warmly called "Amelia's Law", which, much like the insurance regulatory bill "Michelle's Law", is a bit premature. Like Michell's Bill, Amelia's Bill has a very strong chance of being passed, but that remains to be seen as of this writing.
The story behind Amelia's bill can best be described by Scott, the Samurai:
"This is House Bill 1711 which, in keeping with the current trend, is named after a little girl, Amilia's Law. The story is tragic"
The Samurai goes on to say that that situation is tragic, but the solution proposed under this legislation is neither a solution, nor sensible.
He continues:

The gist is that they were having some remodeling done, a gas line was accidentally cut by the carpenter while doing some demolition (it'snot even clear he was aware the line was cut because the gas was off at the time and the noisy, dirty nature of doing demolition work). Family comes up (from Massachusetts), turns on the gas and the furnace and BOOM. Everyone escaped except their little daughter."
The Samurai continues:
"...Horrible tragedy but here's the kicker: this bill, even if in force
at the time, would NOT have prevented this disaster. The bill seeks
to require training for tradesmen who work with gas-- the carpenter
doing the demolition would have had no reason to seek such training. And, as mentioned, it's not even clear that he was aware that he had cut the gas tube. All this will do is make it even more difficult for people living in rural New Hampshire to get appliance repair service.
And here's another point: I carry one million dollars worth of
liability insurance. If this propane training requirement had any
proven merit, my insurance company would have required that I get it as a condition of being insured!
Hearings on House Bill 1711 are on Feb 9."
The effect of this bill will be to provide the artifice of state protection, when it is the carrot and stick provided by market success and failure that raise standards of safety and quality. It will also cause the price of services for tradesmen to rise, forcing some poorer people out of the market for the services.
The prime sponsor of the bill will be on "Against the Grain" on Tuesday, January 31, 2006.
