Yes, a three judge panel ruled 2 to 1 Friday that the INDIVIDUAL MANDATE portion of the federal medical fascism law is unconstitutional. The majority said that this is a dangerous precedent, unseen in US history, and it could lead to other mandates, like the feds telling people they have to eat broccoli (was that a Bush I appointee?;)). They are correct in that, and also correct in stating that such a mandate is not specifically enumerated in the Constitution as a power granted the feds. But they show their inconsistency in not applying it in other cases. For example, if it is not a power granted to Congress to force people to pay for insurance, how is it Constitutional to force them to pay for a so-called (bogus) "Social Security Insurance" program?  And how about "Medicaid"? Ahhh, you see the feds "merely" force you to pay THEM for their fake "insurance" slush funds and redistribution systems. Soooo, we can see how the statists will answer the courts if this decision is upheld by the Supreme Court. They will simply impose a new "Health Insurance Withholding Tax" similar to the SS and Medicaid taxes already withheld. The courts would NEVER apply their logic that the Congress doesn't have the power to force you to pay for these unconstitutional programs, because, despite the fact that they are not allowed in the enumerated powers, they don't want them to stop. So, Congress will start a tax, AND this ruling serves the statists' purposes in another way!

It will temporarily stop forcing healthy younger people to buy insurance, but it will continue to force the insurance companies to accept people with pre-existing conditions, which will drive premium costs higher, making the public HATE insurance companies even more, and call for more federal insurance regulation... which will, of course, lead to more people choosing the federal insurance program, and dry up the pool of people who would usually buy private insurance policies. It will help kill private insurance. Surely, many of the statists who wrote the law knew this would happen in the courts. The game's afoot, Watson!

The only way to stop this is to confront the statist politicians, get others into office, call talk shows, protest, and openly resist the law.
