NY State Using HIPAA (aka HIPPA) to Collect Med Data, Seize Guns from Folks Who've Taken Anti-Anxiety Meds

Many years ago, libertarians tried to sound the alarm about HIPAA, the Orwellian "Health Insurance Portability and Accountability Act", which imposed anti-constitutional regulations on private health insurance companies and doctors to MAKE them get patient permission before sharing patient health data. Hey, we freedom-lovers often speak in favor of privacy, but if a company does not offer to keep medical data private when one signs on, then they should be free to share it. If they promise to keep things private (which slows the data flow if one of their patients is in an accident) then they share it, the patient can go after them for fraud and breach of contract... In a voluntary system, people accept or deny these kinds of impositions or services based on their own preferences.

The anti-constitutional imposition on companies is clear. The ORWELLIAN part of it stems from the fact that HIPAA first shuts down data sharing by private companies based on their contracts, THEN IT ALLOWS THE FEDS AND STATE AGENCIES TO COLLECT THAT VERY SAME DATA! It is Newspeak straight out of "1984", where the gubment tells you the bill insures your medical privacy, while it writes itself the power to take your medical data contrary to the 4th Amendment's proscription against unwarranted searches and seizures.

Now, as predicted by, um.... Oh yeah, LIBERTARIANS, one state gubment is using medical data to take away the firearms of a man who has never been convicted of any felony. His mistake? He took anti-anxiety medication.

We said it would happen, and it is happening. It will happen more.
