Man Detained for Video Recording Baltimore Rail
Despite the fact that there is no statute making it a crime, he is approached by police and told to stop. When he does not, they shift over to the wiretap law, to tell him they have not given him permission to record their voices. Of course, he was alone, and THEY APPROACHED him, knowing that he was recording, so their permission was implicit.
The wiretap law is being used more and more to try to prevent people from recording police engaging in erroneous and nefarious activity. It has nothing to do with wiretapping and everything to do with preventing the public from seeing cops at their worst.
The man recording things, although at times intimidated, held his ground, and was smart about how he handled the cops. They detained him without charge.
