Anti-trust in College Footbal is bad
In another thread, it was being Gardner stated that anti-trust is infuriating,
Now I agree that anti-trust litigation is generally a bad thing. A while back, though, I heard of a group in New Hampshire that wants to challenge the monopoly of the New Hampshire Bar Association via anti-trust litigation. I think that this a very interesting use of anti-trust statutes.
How else can one end the cartelization of professional legal services, given the current paradigm?
Boy, Furb, did you bring up a fascinating subject! the fact that you basically can't work in a NH court unless you're a member of the bar is pretty easily discrned, and the NH Bar is a very restictive club. The lawyers who become judges will rarely work with anyone who isn't in the Bar. In one way, this runs counter to the Contract Clause of the US Constitution, the trouble is that these are NH gubment courts we're talking about... So what to do? The antitrust idea is a fascinating one. of course, no US Circuit court would take the case, but it's a great point to bring up. The NH Court system is a very closed one, and the attempt to break its monopoly is valuable...
Man, this is a quandry! The legislature will never change the laws for procedure, to allow more people easier access to represent themselves, and the Bar certainly won't open things up... Hmmm.. I need to think about this...
