But what is missed is that the laws must be constitutional, and members of all state legislatures, judicial and executive branches swear an oath to uphold the US Constitution. Their oaths to uphold the US Constitution REQUIRE them to nullify all unconstitutional laws. The same goes for a President who sees the Congress pass unconstitutional laws. As Jefferson noted, it is his duty to not execute those laws.
