Despite Bush Attempt to Smother Habeas for Non-War Captures, Gitmo Suspects FINALLY Appear in US Criminal Court

As we have mentioned here, without a Declaration of War by Congress, anyone captured in a military operation by US forces must be tried under US Criminal law. The Bush Administration did not want to acknowledge that fact, and neither did many Democrats who voted in the House and Senate for Bush to use the troops without a Declaration of War.

 

As a result, many innocent (and surely many not-so-innocent) men have sat in Gitmo for years without Habeas Corpus hearings in which the government presents the evidence against them.

Now, some of these people are getting their trials, and many are being released because they were not involved in terrorist activities. Some have already returned to Iraq and Afghanistan and are leading peaceful lives. Some might go underground and join anti-US cells. Certainly the Bush plan has inspired more hatred of the US government.
