Covered today by El G Grande: The Supreme Court decision regarding habeas corpus and Gitmo is a legacy of the Bush Administration's desire to wage a war without asking Congress to declare War. Without a declaration of War (the only provision in the Constitution that allows the President to then lead the troops into battle; there is a provision for issuance of letters of marque and reprisal, but that is a different issue), those captured by US forces MUST be tried under US criminal code, just like all the other suspected terrorists in US history.
